I am there with all of you who are wanting to file a lawsuit against GMAC! 99.9% of us are in the same boat- GMAC screwing us over. I'm trying to understand -why they wanted someone to help them hold on to their billion dollar company(and we did), but they are not willing to help anyone hold on to their homes. Lets do it! |
| 3. Written by Wendy S. on February 19, 2011 from bossier city, louisiana, US My son financed a car through GMAC/Ally about 7 months ago and I co-signed for him. On December 12, 2010 a drunk driver hit him and totaled the vehicle. The car was towed to a storage facility who notified Ally that it was there. We had State Farm requesting the vehicle be towed to a repair shop for visual inspection but when I called the storage yard I was informed that Ally had picked the car up. This was done without notification to myself or State Farm. The loan was always paid on time and never paid late but because Ally picked up the car they listed it as a repo on our credit report. Ally refuses to accept the pay off check from State Farm and each day the interest charges increase. It took over a month for Ally to give State Farm the payoff which only increased it as each day storage fees were being added. Im at a loss as to how this situation can be resolved without an attorney because I get no help from any Ally representative and have been told the repo will not be removed and the payment will not be accepted. I have been turned down for loans because of this and in April 2011 the balloon payment is due to be refinanced on my home. I could lose my home over this! |

The management knew they had a problem and said ( forced us ) that is we the people do not bail them out they will be forced to go out of business. OK. So we bail them out, save hundreds of thousands of jobs and say good luck. Now, I have had a difficult time over the past 3 years, lost job, do not qualify for AID, sold my house, cashed in my 401k. after I exhausted all other options available to me I became homeless ( only 6 months ) during that time I knew that I could not afford the truck so I called GMAC, explained my situation and asked what my options were, if any. They did offer me a 1 time "modification" basically let me skip 1 month and add it on at the end for a small fee now. Since I did not have the money to make a payment how did they think I had the money to make this modification ? SO I said "no thanks, I would like to Voluntarily Turn my truck in ". I arranged a time, met the Service company, gave them my truck and said sorry. 9 months later I am being sued for the $11,000 difference between what the price they received for the truck @ auction and what the Contract price was. Interesting that even they could not sell the truck for anywhere near the so called "value". The reason the truck has no "Value" and could not fetch a better price at auction is because GMAC declared Bankruptcy, dumped thousands of trucks on the market and reduced the prices to Less than what I owed for a New truck. How I am supposed to deal with that ? We all helped them with the bail out, which lowered the value of all "new" trucks on the market. I am counter suing GMAC. Should be an interesting day in court. |

I asked for my pay off total to receive my title, was given the amount and told to call in with a confirmation # so they could make note of my payment. I called 4 days later to make sure they received payment and my title would be on its way. Now I am told I owe another $118.00...I have a 1.9% APR and in 4 days how in the *** could that be right?! They won't admit they screwed up! They need a law suit because if people just keep paying the extra and backing down they will continue to screw over everyone! |

| 10. Written by Justin on May 8, 2010 from waterville, maine, US If you folks are serious about beginning a class action suit against GMAC I would be on board. I won't bore you with the details of my particular situation, but it's pretty much the same as everyone else's. I was out of work for a year, went back to work in January of 2010 and have been trying to get a loan modification ever sinse. It's the same old BS...they keep stating that my loan mod package is incomplete, even though I saved the confirmed copy that is 100% complete. In addition, many of their representatives agree that they have a complete application. I'm beginning to record my phone conversations with them beginning tomorrow. Justin |
