GMAC services my loan. I did not choose them, my servicing was sold to them. They overpaid my taxes by nearly $3,700. After about a dozen phone calls and two months later, they still have not sent me a refund check. Their customer service personnel are not based in the U.S. I've been hung up on several times, promised callbacks and have tried on many occasions to speak to a competent supervisor (most are taking calls) - they keep promising that the next work order will get me my money. At this point in time I have no recourse except court. That will cost me more than my refund which seems rediculous. So my money is held ransom while I get frustrated trying to talk to someone who can speak English and understands my situation. 1286c93

Folks, please file a FORMAL complaint with your Attorney General's Office, Office of Financial Regulation, Federal Trade Commission, and the Better Business Bureau. Otherwise GMAC will continue with the fraudulent practices. I'm filing a complaint too because GMAC messed up my scrow account and have not corrected it despite several phone calls, e.mails and certified letters.

In Oct of 08 GMAC made a prop. tax payment on my behalf claiming I had missed the previous installment. I already told GMAC that the taxes were current as of two months prior and even sent in proof of payment. GMAC is claiming the proof of payment was not receied, and it does not matter whether I can prove I mailed it. GMAC then demanded i reiburse them in full for their surplus tax payment. I told them I did not owe them money, but they could get a refund from the county for their overpayment, but they needed to send in a written request for such. They did nothing. The surplus funds were then applied to my next tax bill. GMAC then started siphoning off funds from my mtg payment forcing me to pay GMAC the funds. They did this for two months in a row and jumped on those credit reports to claim that i was behind in my primary morthage. BofA and Citibank immediately cancelled the home equity lines of credit that I had set up (as i am self employed). I was then and still am in seriouis financial hardship. I couldnt even afford the insurance premium for the house because it becase due right when the home eq. loans got cancelled....so, GMAC has helped me out financially here with forced coverage at 6 times the normal premium cost for a year. ABSURD.

They Speak English is obviously a pinhead shill for mortgage companies and cant READ ENGLISH. My taxes were to be paid by GMAC via my escrow account as per my mortgage agreement. Tax bills are sent directly to GMAC by the local tax offices. THEY are the ones who did not send the payment by the due date. Unlike GMAC, I pay my mortgage on the first of the month when its due - EVERY MONTH. The least GMAC could do is pay my tax bills on time while they collect interest off my escrow account (of which I get $0) 

 

I was so happy to hear that GMAC mortgage unit was cutting its work force by 5,000 employees - maybe they will get rid of some of these dead wood do nothing employees.  

 

GMAC eventually did pay the taxes but only after I threatened legal action if the bills were not paid within 7 days. Amazing what mentioning the words "legal action" and mentioning the law firms name will do.  

 

After seeing how GMAC and all these other corrupt companies have threatened to destroy the entire banking system with their sub prime loans and other BS mortgage products, its really no suprise GMAC and other such companies have so many complaints on the net  

 

Next year I am paying my own taxes - I ALWAYS pay my own bills - I have a spotless credit report and I refuse to allow GMAC and its incompetent employees put my credit rating at risk. 

 

Also I caught GMAC illegally padding my escrow account by more than the 2 months allowed by law. They managed this my creating an artificially low starting point for the escrow analysis. After sending them my own analysis they finally "fixed it" earlier this summer, but couldnt explain where the low starting balance came from. I suspect they do this to keep this to keep themselves afloat since they too got caught with the fingers in the sub prime mortgage meltdown cookie jar.  

 

But after they failed to pay yet another of my property tax bills on time this year, Im paying my own bills and I suggest everyone else do the same - they simply cant be trusted.  

 

The biggest problem with GMAC regarding escrow is they wait until 7 days before a bill is due to pay the property tax bills - leaving no time in the event something goes wrong. Of course they do this milk their customers escrow accounts of the last little bit of interest they collect off their customer escrow accounts.

GMAC screwed up my property tax payment last year by lumping it in with several others. The total check amount for all the payments was wrong so the tax office returned the check since they are not allowed to accept it unless its 100% correct. I too phones several times and I could tell it was somewhere in India as I work with people from that country and recognized the accents. Not until I threatened to take legal action did they finally reissue a single check for my accounts only and a 2nd check for the penalty for being late. So if you keep having trouble, email them and tell them if they dont resolved the matter in 7 days you will consult a lawyer. Its a shame that customers have to baby sit billion dollar companies and make sure they make the correct escrow payments. Im thinking of closing the escrow account and paying the taxes myself. I would also earn some interest of the money instead of GMAC doing it.

FYI - They speak English. Had you paid your taxes insteadof letting them get deliq. or provided correct docs then this may not have happened.
